5 year prison sentence for Haley Brooke’s DWI death
Tina’s family sobbed in the courtroom behind her as state District Judge David Wilson passed her into the custody of the sheriff’s office on her way to 5 year sentence.
“Due, wearing a floral dress, seemed dazed as she took her place among the shackled prisoners in orange jail garb. Family members comforted each other as she walked past her attorney, Edward McFarland.”
It was a tragic case, because it’s horrible for any parent to lose a child, District Attorney Clyde Herrington said.
“Nonetheless, I don’t think we can excuse her conduct because it was her child,” he said.
McFarland was not immediately available for comment.
The 38-year-old mother’s blood alcohol level was 0.199 – nearly 2½ times the legal limit of .08 – on Aug. 23, 2004, when she flipped her sports utility vehicle going into a curve on FM 1669 north of Huntington, according to an arrest affidavit.
Her three children, including 8-year-old twins Haley and Hunter, and another daughter, Kelsey, 7, were sitting unbelted in the car, which was loaded with school backpacks and groceries. Haley was thrown from the vehicle and died at the scene.
Due pleaded guilty to intoxication manslaughter. She faced up to 20 years in prison.
